Pager Health privacy policy
This Privacy Policy (“Privacy Policy”) describes how Pager, Inc. d/b/a Pager Health (referred to herein as “Pager Health,” “we,” “us,” and “our”) protect, collect, use, disclose, and store the information collected through the Pager Health website (www.pagerhealth.com) and/or the Pager Health mobile applications (“Applications,” and, collectively, with the website, “Platforms”). For purposes of clarity, our website is provided for informational purposes only. Pager Health services are offered only through the Applications. The Applications are accessible only to: (a) individuals who are members or beneficiaries of Pager Health’s health plan and/or employee benefit plan customers; and (b) individuals who are patients of Pager Health’s health system customers.
We are committed to respecting the privacy of users of the Pager Health Platforms
Some of our Applications may be used to connect with healthcare providers that have entered into an agreement with us (“Provider(s)”). Once you select one or more Providers through the Platform to provide services to you, each of those Providers may be referred to as “your Provider.”
BY DOWNLOADING, ACCESSING, OR USING THE PLATFORMS, AND/OR BY REGISTERING WITH US OR PROVIDING INFORMATION TO US IN CONNECTION WITH THE APPLICATIONS, YOU ACCEPT THE PRACTICES AND POLICIES OUTLINED IN THIS PRIVACY POLICY, AND YOU HEREBY CONSENT THAT WE WILL COLLECT, USE, AND SHARE YOUR INFORMATION AS SET FORTH IN THIS PRIVACY POLICY. IF YOU ARE REGISTERING AN ACCOUNT ON, OR OTHERWISE USING, THE APPLICATIONS ON BEHALF OF AN INDIVIDUAL OR ENTITY OTHER THAN YOURSELF, YOU REPRESENT THAT YOU ARE AUTHORIZED BY SUCH INDIVIDUAL OR ENTITY TO ACCEPT THIS PRIVACY POLICY ON SUCH INDIVIDUAL'S OR ENTITY'S BEHALF.
We may change this Privacy Policy at any time and any changes to this Privacy Policy will become effective when we make the revised Privacy Policy available through the Platforms. We will update the “Last revised” date at the top of this Privacy Policy if we make any such changes to this Privacy Policy. Your use of or access to the Platforms or the submission of any information in connection with the Platforms following any change means that you accept the revised Privacy Policy.
Jurisdictional issues
Pager Health is headquartered in the United States, and as a result, your Personal Information will be processed by Pager Health in the United States. Data protection laws in the United States or other countries may not offer you the same protections as the laws of the country in which you are residing when your Personal Information is collected. By using the Platforms and by submitting your Personal Information to Pager Health, you consent to the transfer of your Personal Information to any country and its use and disclosure in accordance with applicable U.S. federal and state laws and with this Privacy Policy.
Personal information
Personal information we may collect
“Personal Information” is any information relating to a natural person who is, or can be, identified either directly or indirectly from such information and includes information such as a user’s name, address, telephone number, email address, Internet activity (such as browsing history), or other information directly linked to that person.
You are required to provide certain Personal Information to us in order to use the Applications. We and our service providers collect Personal Information from you that may include, but is not limited to:
your name and your contact data (such as your email address, phone number, billing and physical addresses);
your login information relative to the Application(s);
demographic data (such as your gender, your date of birth and your zip code);
insurance information (such as your insurance carrier and insurance plan);
health, medical, and wellness data (such as previous doctors, dentists or other health care providers you visited, your reason for visiting those providers, your date of visiting providers, your medical history and condition, and other medical, health, wellness, and fitness information you choose to share with us) that you provide through the Application(s); and
If you communicate with us by, for example, phone, email, or letter, any information provided in such communication may be collected as Personal Information.
We may also collect demographic information and health/medical information (e.g., medical history, lab results) from your insurer/health plan, employee benefit plan, or health system.
Certain Personal Information collected by Pager Health may be considered as sensitive Personal Information under applicable law (e.g., health-related information, insurance information).
In addition to information that you provide when interacting with our Applications, we also automatically collect certain Personal Information through the use of cookies and other tracking technologies across our Platforms. As you navigate through and interact with our Platforms, we may use automatic data collection technologies to collect certain Personal Information about your equipment, browsing actions, and patterns, including, more specifically:
Usage Details. Details of your visits to our Platforms, such as traffic data, location, logs, referring/exit pages, date and time of your visit or use of our Platforms, error information, clickstream data, and other communication data and the resources that you access and use on or in the Platforms.
Device Information. Information about your computer, mobile device, and Internet connection, specifically your IP address, operating system, browser type, and mobile application version information.
Location Data. Information about your location collected through Geolocation technology.

How we may use personal information
We and our third-party service providers may use Personal Information to:
enable your use of our Platforms and their functionality, contents, and services;
provide you with our products and Platforms;
provide you with notices about your account(s);
respond to your inquiries and fulfill your requests, such as to arrange transportation for a house call or to establish a telephone conference;
send to you administrative information, including information regarding the Application(s), and changes to our terms, conditions and policies;
schedule and provide services related to the scheduling of house call appointments, for example, to send to you appointment confirmation; communicate with you and your Providers regarding your health status, appointments and related services provided by your Provider; obtain or facilitate payments for appointments and related services provided by your Provider and send you payment receipts; and provide you with related customer service;
confirm that services you request were provided to you by your Providers;
send to you marketing communications that we believe may be of interest to you;
personalize your experience on the Platforms by presenting products and offers tailored to you;
fulfill any other purpose with your consent;
further our business purposes, such as quality assessment, data analysis, audits, developing new products, enhancing the Platforms, improving our product and service offerings, identifying usage trends, developing tools to assess the performance, competence and qualifications of healthcare professionals and conducting training programs for such professionals, and determining the effectiveness of our promotional campaigns; and
act as we believe to be necessary or appropriate: (a) under applicable law; (b) to comply with legal process; (c) to respond to requests from public or government authorities; (d) to enforce our Terms & Conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, or that of our affiliates, you or others; (g) at our discretion under emergency circumstances, to notify emergency services or your family members, personal representative or other individuals involved in your care of your location and condition; or (h) to allow us to pursue available remedies or limit the damages that we may sustain.
Our use of your health-related Personal Information may also be subject to certain restrictions set forth in an agreement between us and your Provider, health plan, or employee benefit plan.
Notwithstanding the foregoing, Pager Health may also use your Personal Information to create de-identified information.
How personal information may be disclosed
Your Personal Information may be disclosed to:
our third-party service providers that provide services such as hosting of the Platforms, data analysis, IT services and infrastructure, customer service, email delivery, auditing and other similar services;
Providers, including your Providers, to schedule and fulfill appointments and provide healthcare services and confirm those services were delivered to you;
our affiliates, for the purposes described for Personal Information in this Privacy Policy, including marketing purposes relating to their products and services;
third parties, to permit them to send marketing communications to you regarding our products or services or the services of your Providers;
identify you to anyone to whom you send messages through the Platforms;
a third party for other treatment, payment or health care purposes of your Provider;
a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, liquidation or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceeding);
other users for Team Challenges: Team Challenges are available to participate in via the Platforms. Team Challenges are voluntary, but if you elect to participate in a Team Challenge, you acknowledge that you will be disclosing some of your Personal Information such as your name, email address, and progress in the challenge to other members enrolled in the challenge. Your team’s total progress may be shared with other teams for the purposes of the Challenge. Pager Health may also share your name and email address with members of your prior teams for the purposes of inviting you into new Team Challenges;
to employers, to the extent your access to the Platforms is through an employee benefits plan made available by your employer. Generally, information we provide to employers is limited to information such as whether an employee completed their health assessment, or general aggregated statistics about their employees’ use of the Platforms;
to insurers, to the extent your wellness benefits are provided through an insurer/health plan (“Insurer”). Note that any Personal Information pertaining to a member of the Insurer’s plan which is collected by Pager Health can be shared with the Insurer. Pager Health limits the information collected to the amount of information reasonably necessary to provide the services to the customer Insurer; and
a third party as we believe to be necessary or appropriate: (a) under applicable law; (b) to comply with legal process; (c) to respond to requests from public or government authorities; (d) to enforce the Terms & Conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, or that of our affiliates, you or others; (g) at our discretion under emergency circumstances, to notify emergency services or your family members, personal representative or other individuals involved in your care of your location and condition; or (h) to allow us to pursue available remedies or limit the damages that we may sustain.
Our disclosure of your health-related Personal Information may also be subject to certain restrictions set forth in an agreement between us and your Provider.
We may also disclose de-identified information for any legally permissible purpose.
THIRD PARTIES
This Privacy Policy does not address, and we are not responsible for, the privacy, information or other practices of any third parties, including Providers, the manufacturer of your mobile device, and any other third party mobile application or website to which the Platforms may contain a link. We encourage you to review the Notice of Privacy Practices of any Provider who provides you with clinical services and the privacy policies of each website and application you visit and use.
HIPAA
In certain arrangements Pager Health acts as a business associate to covered entities, such as Providers and Pager Health’s health plan customers. Accordingly, some Personal Information we collect may include health and/or medical information that constitutes protected health information (“PHI”) under the U.S. Health Insurance Portability and Accountability Act of 1996 and its implementing regulations (“HIPAA”). Pager Health maintains physical, technical, and administrative safeguards that comply with federal regulations to reasonably protect PHI. Pager Health will only use and disclose PHI as permitted by HIPAA and Pager Health’s business associate agreements with covered entities.
If you utilize a Pager Health Application that enables you to connect with, and receive clinical services from, a Provider, please be aware that this Privacy Policy is distinct from the Provider’s HIPAA Notice of Privacy Practices, which describes in detail overall how your Provider uses and discloses your individually identifiable health information. If you would like to review a copy of your Provider’s HIPAA Notice of Privacy Practices, please request a copy directly from your Provider.
COMMUNITY FEATURES
Certain Applications may feature community areas and other public forums where users can share information and post reviews or questions. Any information that you may reveal in a review posting or other online discussion or forum is intentionally open to the public and is not in any way private. You should think carefully before disclosing any Personal Information in any public forum. What you have written may be seen and/or collected by third parties and may be used by others in ways we are unable to control or predict.
SECURITY
We use reasonable physical, technical and administrative measures to protect Personal Information under our control. Unfortunately, no data transmission over the Internet or data storage system is 100% secure, and therefore we cannot guarantee against all potential security breaches.
If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), please immediately notify us of the problem by contacting us in accordance with the "Contact Us" section below.
CHOICES AND ACCESS
Your choices regarding our use and disclosure of your Personal Information
We give you choices regarding our use and disclosure of your Personal Information for marketing purposes. Specifically, you may opt-out from:
Receiving marketing-related emails from us based upon your Personal Information: If you no longer want to receive marketing-related emails from us on a going-forward basis, you may opt-out of receiving such marketing related emails by sending an email to [email protected].
Our sharing of your Personal Information with affiliates for their marketing purposes: If you would prefer that we do not share your Personal Information on a going-forward basis with our affiliates for their marketing purposes, you may opt-out of such sharing by sending an email to [email protected].
We will try to comply with your request(s) as soon as reasonably practicable. Please note that if you opt-out as described above, we will not be able to remove your Personal Information from the databases of our affiliates with which we have already shared such information (i.e., to which we have already provided such information as of the date that we implement your opt-out request). Please also note that if you do opt-out of receiving marketing-related messages from us, we may still send administrative messages to you; you cannot opt-out from receiving administrative messages.
We do not currently respond to web browser “do not track” signals or other mechanisms that provide a method to opt out of the collection of information across the networks of websites and online services in which we participate. If we do so in the future, we will describe how we do so in this Privacy Policy.
If you are a registered user of an Application(s), you can modify some of the Personal Information you have included in your profile or change your username by logging in and accessing your account. Upon your request, we will use commercially reasonable efforts to delete your account and the Personal Information in your profile; however, it may be impossible to remove your account without some residual information being retained by us, and we may be required by law or our agreement with your Provider, health plan, or employee benefit plan to retain certain information. We have no obligation to delete any data or information you provide on a Medical History Form following termination of your account or the account of any Provider to whom your Medical History Form was submitted through the Application. Registered users who wish to close their account(s) should email: [email protected].
Use of application by minors
The Platforms are not directed to individuals under the age of 13, and we do not knowingly collect Personal Information from users under the age of 13 without express consent from the user’s parent or legal guardian. If we learn that we have received any information from an individual under the age of 13, we will use that information only to respond directly to that child (or a parent, legal guardian or personal representative) to inform him or her that he or she cannot use the Platforms and subsequently we will delete that information from our own servers. However, if you are a parent, legal guardian or personal representative of a minor child, you may, in compliance with the Terms & Conditions, use the Platforms on behalf of such minor child or authorize your minor child to use the Platforms. Any information that you provide us while using the Platforms on behalf of your minor child will be treated as Personal Information as otherwise provided herein.
